Judge: Sohos The Wall stays
A federal judge has upheld an October 2000 decision by the citys Landmarks Preservation Commission that the owner of 599 Broadway cannot remove Forrest Myers The Wall, a 1973 public artwork, from the side of the building at the southwest corner of Broadway and Houston St.
In her Sept. 10 ruling, Judge Deborah A. Batts dismissed the owners First Amendment claims, arguing that the artworks presence was not necessarily burdensome. The buildings owner had argued that the support bolts on the walls exterior to which the artwork is attached were causing leaking.
